Terms of Service
Terms for using Survive The Snail, including the app, website, game features, social features, purchases, notifications, and related services.

1. Agreement
These Terms of Service ("Terms") govern your access to and use of Survive The Snail, including the mobile app, website, game features, social features, purchases, notifications, and related services (the "Service").
The Service is operated by LKG Labs LLC ("LKG Labs," "we," "us," or "our"). Contact us at support@survivethesnail.com.
By creating an account, tapping to accept, making a purchase, or using the Service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must meet the minimum age shown during signup and be legally able to enter these Terms. The app currently applies a minimum age of 16 in EEA regions and 13 elsewhere, with a server-enforced 13-year floor. If local law requires parental or guardian authorization, you may use the Service only after that authorization is obtained.
You may not use the Service if we previously suspended or terminated your account for a serious violation unless we authorize you to return.
3. Accounts
You are responsible for providing accurate account information, keeping your login credentials secure, and promptly notifying us of unauthorized access. You may sign in with email/password, Apple, Google, or other supported providers. Your use of those providers is also governed by their terms.
We may require email verification, age eligibility, Motion and Fitness permission on supported devices, profile setup, height, weight, and daily goal setup before you can begin a chase.
You may delete your account in the app from Edit Profile > Delete Account. Account deletion does not automatically refund purchases handled by Apple, Google, or another app-store provider.
4. The Service
Survive The Snail is an entertainment and fitness-motivation game. It converts supported Motion and Fitness/pedometer activity into fictional chase progress, lead distance, daily goals, challenges, leaderboards, achievements, shop items, notifications, and rewards.
The Service is not medical advice, a medical device, a health-care service, a safety service, or an emergency service. Do not rely on the Service to diagnose, treat, prevent, or monitor any medical condition. Consult a qualified professional before changing physical activity if you have health concerns.
5. Activity Data, Permissions, and Device Limits
The chase cannot work without activity processing. You must grant Motion and Fitness/pedometer access on supported devices for the app to start and maintain a chase. Background refresh, live updates, and historical activity sync depend on your device, OS permissions, battery settings, network connection, and platform limitations.
Activity data can be delayed, incomplete, or inaccurate. Steps, distance, calories, active minutes, rankings, streaks, and caught outcomes are gameplay calculations, not guaranteed measurements. We may correct, recalculate, withhold, or invalidate activity, scores, rewards, or challenge results when data is unavailable, inconsistent, fraudulent, or affected by technical error.
6. Safety
Use common sense when walking, running, or using the app. Do not look at your phone in unsafe situations, enter dangerous areas, trespass, ignore traffic, drive while using the app, or take unsafe actions to gain steps or game progress. You are responsible for your own physical safety and for following local laws.
7. Privacy
Our Privacy Policy explains what information we process, why we process it, who receives it, how long it is retained, and what controls may be available. By using the Service, you agree that we may process information as described in the Privacy Policy.
8. Social Features, Challenges, and Visibility
The Service includes usernames, display names, profile photos, searchable profiles, friend requests, private profiles, blocks, reports, challenge invitations, challenge scores, leaderboards, achievements, events, and reactions.
Your username, display name, profile photo, and limited profile identity may be visible to other signed-in users. Public profiles may appear on global leaderboards. Private Profile hides you from the global leaderboard and limits activity/chase detail visibility to friends, but your basic profile identity may remain searchable so people can send friend requests.
Challenge participants can see relevant challenge details and activity-based scores for that challenge. Other users may see reactions and events associated with a shared challenge.
9. User Content
"User Content" means content you provide to the Service, such as username, display name, profile photo, challenge names, reports, reactions, and other material you submit.
You keep ownership of your User Content. You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, resize, display, transmit, moderate, and use your User Content only as needed to operate, protect, improve, and promote the Service. This license ends when the content is deleted from active systems except where retention is allowed for backup, safety, legal, fraud-prevention, accounting, or enforcement purposes.
You represent that you have the rights needed to submit your User Content and that it does not violate these Terms or the rights of others.
10. Acceptable Use
You may not:
- harass, threaten, abuse, bully, exploit, or discriminate against others;
- impersonate another person or misrepresent your identity;
- submit unlawful, hateful, sexual, violent, infringing, deceptive, or otherwise harmful content;
- cheat, spoof, manipulate, automate, falsify, or interfere with activity data, purchases, ads, leaderboards, challenge results, or rewards;
- scrape, harvest, sell, or misuse user information;
- reverse engineer, probe, attack, overload, bypass, or disrupt the Service or its access controls;
- introduce malware, harmful code, or unauthorized automation;
- use the Service for commercial activity unless we authorize it;
- violate law, platform rules, third-party rights, or these Terms.
11. Moderation and Enforcement
We may remove content, limit visibility, disable features, withhold rewards, recalculate results, suspend accounts, terminate accounts, or report conduct when we reasonably believe it is necessary to enforce these Terms, protect users, protect the Service, comply with law, prevent fraud or cheating, or address security issues.
Where appropriate, we will provide notice and an opportunity to contact us. You may appeal enforcement decisions by emailing support@survivethesnail.com.
12. Coins, Virtual Items, and Purchases
The Service may offer virtual coins, shop items, Pro entitlements, ad-free benefits, or other paid features. Paid features may be offered only on certain platforms, regions, or app versions.
Virtual coins and items:
- are licensed, not sold;
- have no cash value;
- are not legal tender, stored value, or property;
- cannot be transferred, sold, traded, redeemed for cash, or used outside the Service except where we expressly allow it;
- may be adjusted, reversed, revoked, or reissued to correct fraud, abuse, chargebacks, refunds, technical errors, or rule violations.
Purchases are processed by Apple, Google, RevenueCat, or another disclosed platform or payment provider. The price, refund rules, taxes, and other purchase details shown at checkout are part of these Terms. App-store rules and mandatory consumer rights also apply. Refund requests are handled by the platform unless applicable law requires otherwise.
13. Advertising
Free accounts may see ads. The current app uses Google AdMob banner ads where enabled and requests non-personalized ads. Active Pro status suppresses banner ad display where supported. Advertising availability, consent forms, privacy options, and ad formats may vary by region, platform, account status, and app version.
You may not manipulate, automate, or fraudulently interact with ads or ad rewards.
14. Intellectual Property
The Service, including software, game rules, design, artwork, characters, text, trademarks, logos, animations, databases, and other materials, is owned by us or our licensors except for User Content.
We grant you a personal, limited, revocable, non-exclusive, non-transferable license to use the Service for its intended consumer entertainment purpose while these Terms apply. You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Service except as allowed by law or with our written permission.
15. App Stores and Third-Party Services
If you download the app through Apple App Store, Google Play, or another store, the store provider's terms also apply. Store providers are not responsible for providing support for the Service, and they are not responsible for claims relating to the Service except to the extent required by their terms or applicable law.
For Apple-distributed versions, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary after you accept them.
The Service also relies on third-party services such as Supabase, Expo, RevenueCat, Google, Apple, and provider login or payment systems. Their services may be unavailable, delayed, or subject to their own terms and policies.
16. Changes, Availability, and Updates
We may update, change, suspend, or discontinue features when needed for product development, maintenance, security, legal compliance, technical operation, fraud prevention, platform requirements, or business reasons. We may also release app updates that are required to continue using the Service.
We will try to provide reasonable notice of material changes when practical, but some changes may happen immediately.
17. Termination
You may stop using the Service at any time. You may delete your account in the app.
We may suspend or terminate your account or access to features if you materially or repeatedly violate these Terms, create risk for other users or the Service, commit fraud or cheating, infringe rights, or if we must do so for legal, platform, or security reasons.
Sections that by their nature should survive termination will survive, including ownership, virtual items, disclaimers, liability limits, dispute terms, and legal compliance provisions.
18. Disclaimers
The Service is provided with any mandatory warranties or consumer guarantees that cannot be excluded by law. Subject to those rights, the Service is provided "as is" and "as available."
We do not promise that:
- the Service will be uninterrupted, secure, error-free, or available on every device;
- steps, distance, calories, active minutes, rankings, notifications, or chase outcomes will be perfectly accurate;
- activity will sync in real time or in the background;
- leaderboards, challenge results, rewards, or virtual items will be permanent;
- the Service will meet your expectations or produce any health, fitness, safety, or real-world outcome.
19. Limitation of Liability

The final clause should preserve all liability that cannot legally be limited, including liability for fraud, intentional misconduct, death or personal injury where applicable, data-protection obligations, and mandatory consumer remedies.
20. Indemnity
To the extent permitted by law, you agree to reimburse us for losses, liabilities, damages, claims, costs, and expenses, including reasonable legal fees, arising from your User Content, misuse of the Service, violation of these Terms, fraud, cheating, or violation of another person's rights. This section does not limit mandatory consumer protections.
21. Governing Law and Disputes
These Terms are governed by [GOVERNING LAW], without depriving consumers of mandatory protections available in their place of residence.

We may update these Terms from time to time. We will update the effective date and provide additional notice or obtain consent when required by law. If you continue using the Service after updated Terms take effect, you accept the updated Terms.
